General Terms and Conditions for online auctions of YOUHORSE.AUCTION
In these general terms and conditions, the following terms shall have the following meanings:
Delivery Agreement: the delivery agreement completed and signed by Buyer and Seller, from which it appears that collection of the horse by Buyer has taken place;
Hammer Price: an amount bid by the Bidder in an Auction for a Horse;
General Terms and Conditions: these general terms and conditions for auctions of YOUHORSE.AUCTION, both the Online Auctions as well as the Physical Auctions;
Bidder: the person who registers or has registered in a manner prescribed by YOUHORSE.AUCTION in order to be able to participate in an Online Auction;
Consumer: the natural person who is not acting for purposes related to the exercise of a trade, business, craft or professional activity;
Participant: a participant in the Auction, in the capacity of Bidder, Buyer or Seller;
Award: the express declaration by YOUHORSE.AUCTION (on behalf of the Seller) to the Buyer that a bid by Buyer has been accepted as the highest bid and that the Horse on which the Buyer has placed a bid has been awarded to the Buyer. This declaration shall be regarded as an acceptance on behalf of the Seller within the meaning of Article 6:217 of the Dutch Civil Code. This declaration consists of the Purchase Agreement Statement;
Registration: the registration of Seller with YOUHORSE.AUCTION to have a Horse offered for Auction by YOUHORSE.AUCTION on behalf of Seller;
Purchase Agreement: the purchase agreement between Seller on the one hand and Buyer on the other hand which comes into existence as a result of the Award;
Purchase Price: the amount owed by Buyer for the Horse offered for Auction, consisting of the Hammer Price plus the Buyer’s Premium, all to be increased by the applicable VAT rate;
Buyer: the Bidder to whom the Award has taken place;
YOUHORSE.AUCTION: the party facilitating the Auction; YOUHORSE.AUCTION is a trade name of Jumping Talent sale B.V., which is owned by Mario Everse h.o.d.n. Stal Everse B.V. in Waddinxveen (NL);
Personal Data: the personal data that must be provided by a Participant upon registration to YOUHORSE.AUCTION in order to be able to participate as a Participant in an Online Auction and which can be traced back to his or her person;
Online Horse Auction: the YOUHORSE.AUCTION;
Buyer’s Premium: an amount by which the Hammer Price is increased and which amounts to 10% of the Hammer Price, with a minimum of €500.00 excluding VAT;
Buy-back: if Buyer is also Seller of the Horse offered for Auction;
Auction: the online auction organised and facilitated by YOUHORSE.AUCTION via the Auction Website (“Online Auction”);
Auction Service: the mediation in bringing about a Purchase Agreement by facilitating an Auction;
Auction Website: the auction website through which YOUHORSE.AUCTION offers its Auction Service;
Purchase Agreement Statement: the purchase agreement statement sent and/or provided by YOUHORSE.AUCTION (on behalf of Seller) to the Bidder/Buyer and to be completed and signed by Bidder/Buyer;
Sale: if Buyer is a person other than Seller;
Seller: the natural person or legal entity who has instructed YOUHORSE.AUCTION to sell horses in the name and for the account of Seller by means of an Auction.
These General Terms and Conditions apply to the legal relationships between YOUHORSE.AUCTION and Participant. Participant shall be deemed to have accepted the applicability of these General Terms and Conditions. Applicability of any other general terms and conditions is excluded.
All stipulations in these General Terms and Conditions are also made for the benefit of all those who work or have worked for, on behalf of and/or in the name of YOUHORSE.AUCTION. They may invoke the provisions of these General Terms and Conditions directly, as if they were YOUHORSE.AUCTION themselves.
YOUHORSE.AUCTION organises and facilitates the Auction and auctions horses on behalf of Seller, without being or becoming a party to Purchase Agreements that are or may be concluded.
YOUHORSE.AUCTION determines the dates and times on which the Auction takes place.
An Online Auction closes on a pre-announced date and time. The duration of the Online Auction is indicated on the Auction Website. If a bid is placed in the last five minutes before the announced closing time, the closing time shall be extended by five minutes each time. Final closing shall then take place five minutes after the last bid.
YOUHORSE.AUCTION determines the order and sequence of the Auction. YOUHORSE.AUCTION has the right to refuse anyone access to and/or participation in and/or Registration for the Auction, without stating reasons, or to impose further conditions in this respect.
The horses offered for Auction are auctioned/sold as they are, without claim or reduction, in the condition in which they are at the moment of Award, without liability of YOUHORSE.AUCTION concerning the value, condition or quality of the auctioned horses.
A Purchase Agreement is concluded between Buyer and Seller as a result of the Award. In Online Auctions, YOUHORSE.AUCTION will send a written Purchase Agreement Statement to Buyer and Buyer is obliged to return this fully completed and signed to YOUHORSE.AUCTION within seven calendar days after it has been sent.
Horses offered for Auction are sold “by raising bids” with a minimum opening bid made known for the Auction, and YOUHORSE.AUCTION is entitled at any time during the Auction to change the manner in which the Auction takes place. YOUHORSE.AUCTION is entitled, if in the opinion of YOUHORSE.AUCTION there are reasonable grounds to do so, not to recognise a bid.
Collection/delivery can only take place after the full Purchase Price and all other amounts owed by Buyer have been paid to YOUHORSE.AUCTION. As long as YOUHORSE.AUCTION has not received full payment from Buyer, including under any other purchase agreements, Seller shall remain the owner of the horse.
Seller is only authorised to deliver the sold Horse to Buyer after written permission from YOUHORSE.AUCTION.
Buyer must collect the horse from the seller within 14 days after the due date of the Purchase Price including the Buyer’s Premium to Youhorse.auction. If Buyer has not paid the amount due by the due date at the latest or remains in default in collecting or arranging the timely collection of the horse, Buyer shall be in default towards Seller and shall, without prejudice to the right of Youhorse.auction in the event of late payment as referred to in Article 2.2 paragraph 3, compensate Seller for the damage and costs suffered as a result, including stabling costs in the amount of €500.00 excluding VAT per month. If Buyer proceeds to payment of the Purchase Price including the Buyer’s Premium after the period of 14 days after the due date, delivery to Buyer in such case shall only take place after the full damage and costs have been paid.
Upon collection/delivery of the entered Horse, Seller must hand over the passport and registration papers of the recipient mare to Buyer.
At the time of collection/delivery of the purchased Horse, Buyer must exercise due care and unconditionally and fully follow the instructions given by or on behalf of Seller. Buyer is liable for damage caused during or in connection with the collection/delivery of the purchased Horse and shall indemnify YOUHORSE.AUCTION and Seller against third-party claims in this regard.
Seller and Buyer are obliged to notify YOUHORSE.AUCTION in writing within 7 calendar days after the Horse has been collected/delivered.
Ownership of the purchased Horse shall pass to Buyer (provided that all requirements for a legally valid transfer have been met) at the moment of delivery/collection as referred to in Article 1.4 of these General Terms and Conditions, but not before Buyer has paid the full Purchase Price and any other amounts owed by Buyer to YOUHORSE.AUCTION, which acts on behalf of Seller in that respect, including amounts relating to work performed or to be performed for Buyer and/or arising from claims due to failure to perform the Purchase Agreement.
YOUHORSE.AUCTION compiles the (digital) catalogue with the greatest possible care. The information in the (digital) catalogue is intended to give an impression of the quality of the horse(s) offered for Auction, without YOUHORSE.AUCTION thereby striving for completeness and without any rights being derived from it.
The Horse offered for Auction will undergo a veterinary inspection as part of the selection procedure for the Auction. The date on which this/these inspection(s) took place will be made known on request, but this/these inspection(s) will take place within an acceptable period prior to the date of the online auction. These veterinary reports can be requested from YOUHORSE.AUCTION. The contents of these veterinary reports are binding on YOUHORSE.AUCTION and on the Participant.
YOUHORSE.AUCTION is an entrepreneur for VAT purposes. Changes in the applicable VAT rate may give rise to a corresponding adjustment of the VAT percentages to be applied.
For each Horse, it will be made known prior to the Auction under which VAT regime the relevant Horse is auctioned.
If, with regard to the transfer of auctioned horses to another Member State of the European Union, invoicing is made at the request of Buyer with the zero VAT rate, Bidder/Buyer undertakes to fulfil all conditions necessary to realise a legally valid intra-Community transaction.
If application of the zero VAT rate proves to be impossible afterwards for any reason whatsoever, Buyer shall at that moment still owe an amount equal to the amount that would be due if there were a domestic supply of the relevant horse. At the request of YOUHORSE.AUCTION, however, Buyer is obliged to pay the aforesaid amount immediately to YOUHORSE.AUCTION. Repayment thereof shall then only take place if and insofar as Buyer has, to the satisfaction of YOUHORSE.AUCTION, complied with the conditions pursuant to Article 1.7.3. Buyer is liable and shall indemnify YOUHORSE.AUCTION in any event for all damage resulting from non-compliance with the conditions of Article 1.7.3. In addition, Buyer is liable for all judicial and extrajudicial costs incurred by YOUHORSE.AUCTION, with a minimum amount of €1,000 excluding any VAT due.
YOUHORSE.AUCTION is not liable for damage caused by the provision of incorrect and/or incomplete information, regardless of the nature and extent of that damage and that information and regardless of the origin of that information. If the incorrect and/or incomplete information originates from Seller, Seller shall indemnify YOUHORSE.AUCTION against all claims of third parties in this respect.
YOUHORSE.AUCTION is not liable for damage arising before, during and/or after the Auction caused by or to persons and/or by or to goods and/or by or to Horses.
YOUHORSE.AUCTION is not liable for damage, whether direct or indirect and regardless of its nature and extent, as a result of a failure in the performance of an obligation by one or more third parties, including but not limited to failure in the correct performance of obligations of Buyer and/or Seller and/or as a result of any act and/or omission of Participant.
Participant is liable for all damage caused by himself and shall indemnify YOUHORSE.AUCTION against any claim of third parties, including but not limited to other Participants, in respect of such damage, regardless of its nature and extent.
YOUHORSE.AUCTION cannot guarantee that Seller can transfer the ownership of an auctioned Horse to Buyer free and clear of encumbrances and YOUHORSE.AUCTION is not liable for any damage related thereto.
Exclusions of liability of YOUHORSE.AUCTION do not apply in the event of intent or gross negligence attributable to YOUHORSE.AUCTION.
Any liability of YOUHORSE.AUCTION is at all times limited to an amount of no more than €10,000. Claims for damages lapse one year after the day on which Participant or a third party became aware of the damage and the liability of YOUHORSE.AUCTION in that respect.
YOUHORSE.AUCTION does not take out insurance for the benefit of Seller and/or Buyer of the relevant horse. Since Buyer and Seller participate in the Auction entirely at their own expense and risk, YOUHORSE.AUCTION advises them to take out such insurance themselves.
YOUHORSE.AUCTION shall use the Personal Data in accordance with the Privacy Statement on its Auction Website. Participant must always consult the latest changes to the Privacy Statement when visiting the Auction Website. Participant agrees that his Personal Data upon registration and/or sign-up may be used for inclusion in the prospectus. Participant grants YOUHORSE.AUCTION unconditional permission to use such Personal Data, including for the benefit of the prospectus.
The legal relationship between YOUHORSE.AUCTION and Participant as well as the legal relationship between Seller and Buyer shall be governed exclusively by Dutch law, with the complete exclusion of the Vienna Sales Convention (CISG).
If a dispute arises during the Auction concerning the course of events during the Auction, YOUHORSE.AUCTION is authorised to give a binding decision on this and is authorised to continue the Auction by raising bids.
Disputes between parties shall be settled by the competent court in The Hague. Before Youhorse.auction starts proceedings against a consumer-customer before the competent court in The Hague, the consumer shall be given a period of one month as referred to in Article 6:236 sub n of the Dutch Civil Code to still choose the court competent by law by notifying Youhorse.auction in writing. This article does not affect the power of the parties to start proceedings before the court competent by law.
YOUHORSE.AUCTION reserves the right to amend these General Terms and Conditions unilaterally. In the event of amendments, the new General Terms and Conditions shall apply from the next Auction onwards.
If a provision in these General Terms and Conditions is not legally valid, this shall not affect the legal validity of the other provisions. In that case, the provision shall be replaced by a new provision, taking into account as much as possible the purport of the nullified/annulled provision.
In the event of differences between translations of these General Terms and Conditions and the Dutch text of the General Terms and Conditions, the Dutch text shall prevail.
By participating in an Auction, Bidder accepts that he/she unconditionally and without reservation agrees to the conditions and procedures applicable or declared applicable by YOUHORSE.AUCTION to the Auction.
Bidder is obliged to follow instructions and directions given by or on behalf of YOUHORSE.AUCTION in connection with an Auction.
YOUHORSE.AUCTION reserves the right to refuse registration for an Auction and (further) participation of a Bidder in an Auction at any time for reasons of its own, and/or to terminate it unilaterally.
In order to participate as a Bidder in an Online Auction, registration in the manner prescribed by YOUHORSE.AUCTION is required. Bidder must register digitally for participation in the Online Auction on the auction platform on the Auction Website. Bidder shall receive a strictly personal username and password with which access to the bidding system is possible. Bidder is responsible for all acts that take place at an Online Auction and that result from the use of Bidder’s username and password. Bids are made digitally. For each Horse, the highest bid is shown on the Auction Website. The bidding increments are:
€250 per bid up to €4,000
€500 per bid up to €10,000
€1,000 per bid from €10,000 up to €20,000
€2,000 per bid from €20,000 up to €40,000
from €40,000 in steps of €5,000 per bid
If a Bidder places a bid, this bid shall count as an offer to the Seller within the meaning of Article 6:217 of the Dutch Civil Code. A Bidder is bound by a bid which is considered irrevocable and unconditional. Every Bidder who places a bid is deemed to bid for himself/herself and is personally bound towards YOUHORSE.AUCTION and (after Award) towards Seller for the obligations arising from his/her bid towards YOUHORSE.AUCTION and Seller. This also applies if the Bidder placing the bid declares to act on behalf of a third party.
A Bidder with the second-highest bid is obliged to keep his/her bid valid for 14 calendar days after closing of the Auction in the event the highest bid is declared invalid or is not honoured.
Bidder bids at his own expense and risk and is bound by his bid until a higher bid has been accepted.
When placing a bid at an Auction, Bidder cannot invoke bidding or typing errors or mistakes.
Bidder accepts the special circumstances that may occur in an Online Auction, including technical imperfections as a result of which a bid cannot be placed in time.
Buyer owes the Purchase Price by virtue of the conclusion of the Purchase Agreement.
Buyer must pay the Purchase Price in Euros to YOUHORSE.AUCTION within 7 calendar days after the date of conclusion of the Purchase Agreement by transfer to the bank account in the name of YOUHORSE.AUCTION, without any discount or set-off.
In the event of late payment of the Purchase Price, Buyer shall be in default and YOUHORSE.AUCTION shall have the right to sell the Horse privately immediately, whereby the bid of the original Buyer shall no longer apply. Buyer shall never be entitled to any surplus proceeds from a private sale and shall remain obliged to compensate YOUHORSE.AUCTION for any shortfall. In that case, YOUHORSE.AUCTION is furthermore authorised, without notice of default, on behalf of Seller and without Seller’s permission, to consider the Purchase Agreement dissolved without Buyer being entitled to any compensation or damages. In addition, Buyer owes YOUHORSE.AUCTION administration costs amounting to 6% of the Hammer Price and Bidder/Buyer owes YOUHORSE.AUCTION all judicial and extrajudicial costs involved in collecting YOUHORSE.AUCTION’s claim against Buyer, with a minimum of €1,000 excluding any VAT due. Buyer shall not be entitled to set-off.
If Seller or Buyer dissolves the Purchase Agreement or otherwise challenges it, Buyer shall remain liable to YOUHORSE.AUCTION for the Buyer’s Premium, without prejudice to any other right of YOUHORSE.AUCTION in that case. The foregoing shall not apply if a Consumer Buyer in an Online Auction makes use of his right of withdrawal as determined in Article 2.3 of these General Terms and Conditions.
If there is an Online Auction in which Buyer is a Consumer and Seller is a non-Consumer, the provisions of this article shall also apply. The provisions of this article shall not apply in the event of a sale by a Consumer-Seller to a Consumer-Buyer.
The Consumer-Buyer may — in the event of a sale between a non-Consumer Seller and a Consumer Buyer — dissolve a Purchase Agreement concerning the purchase of a Horse via an Online Auction during a cooling-off period of a maximum of 14 calendar days without giving reasons on the basis of the statutory right of withdrawal under Article 6:230o et seq. of the Dutch Civil Code. Seller may ask Buyer for the reason for withdrawal, but cannot oblige Buyer to state his reason(s). The cooling-off period referred to in this article starts on the day after Buyer, or a third party designated in advance by Buyer who is not the carrier, has received the purchased Horse.
If Buyer makes use of the statutory right of withdrawal, Buyer shall notify Seller and YOUHORSE.AUCTION thereof in an unambiguous written manner within the cooling-off period. This notification must be made as soon as possible, but within 14 calendar days from the day following the notification referred to in this article, Buyer shall make the Horse available again to Seller and/or hand over the Horse to Seller. This is not necessary if Seller has offered to collect the Horse himself. Buyer has in any case observed the period of 14 days if he transports the Horse back before the cooling-off period has expired.
Buyer returns the Horse to Seller with — where applicable — all delivered accessories, and in accordance with the reasonable and clear instructions provided by Seller.
The risk and burden of proof for the correct and timely exercise of the right of withdrawal lies with Buyer.
The costs related to the return delivery of the Horse, including transport, are for Buyer’s account.
During the cooling-off period and return shipment, Buyer shall handle the Horse carefully and, if provided, according to Seller’s instructions.
If Buyer makes use of the statutory right of withdrawal, all additional agreements shall be dissolved by operation of law. In the event of withdrawal, Seller shall remain liable to YOUHORSE.AUCTION for the Buyer’s Premium.
Seller shall repay the Purchase Price (including any costs charged by Seller to Buyer for transport of the Horse prior to delivery to Buyer) within 14 calendar days following the day on which Buyer reports the withdrawal, provided that Seller has received the horse within those 14 calendar days. Unless Seller offers to collect the Horse himself, Seller may therefore wait with repayment until he has received the Horse, even if this means that the period of 14 days referred to in this article is exceeded.
Seller shall use the same means of payment for repayment that Buyer used, unless Buyer agrees to another method. Repayment is free of charge for Buyer.
If Buyer has chosen a more expensive method of transport of the Horse, Seller does not have to reimburse the additional costs for the more expensive method.
Buyer is liable towards Seller for any depreciation in value of the Horse that has arisen in the period between delivery to Buyer and return delivery to Seller.
If Buyer makes use of the right of withdrawal as referred to in Article 2.3 paragraph 2, Buyer shall, without prejudice to his rights and obligations arising therefrom towards Seller, at all times owe cancellation costs to YOUHORSE.AUCTION. These cancellation costs amount to 10% of the Hammer Price, with a minimum of €1,500.00 excluding VAT.
The legal relationship between YOUHORSE.AUCTION and Seller is a contract for services. Seller offers a Horse for Auction by means of a Registration.
Seller undertakes to check the correctness of the information in the (digital) catalogue, as referred to in Article 1.7 “Information” of these General Terms and Conditions, relating to the Horse registered by Seller and to notify YOUHORSE.AUCTION in writing of any inaccuracies no later than 7 calendar days before the Auction, stating in as much detail as possible which changes or additions must be made.
The conditions set by YOUHORSE.AUCTION in the context of the Auction for a horse, Registration and Seller are set solely in the interest of a proper Auction.
Seller guarantees that he can transfer full ownership of the Horse to Buyer free and clear of encumbrances. Seller is obliged to indemnify YOUHORSE.AUCTION against claims from Buyer and/or third parties related to Seller’s failure to comply with this guarantee.
Seller guarantees that the Horse is free from prohibited substances, as referred to in the most recent list of the Federation Equestre Internationale (FEI) and available on the FEI website (www.FEI.org), during the selection procedure and the auction. YOUHORSE.AUCTION is entitled during the selection process and prior to the Auction to take blood or urine samples for testing for prohibited substances.
Seller guarantees the correctness and completeness of the (results of the) examinations. Seller indemnifies YOUHORSE.AUCTION against any claim, regardless of extent and nature and regardless of by whom, for non-conformity discovered during or after the Auction in relation to a sold Horse.
Seller is obliged to indemnify YOUHORSE.AUCTION against claims of Buyer and/or third parties related to Seller’s failure to comply with these guarantees or any other claim by third parties.
Registration takes place by completing, signing and sending the YOUHORSE.AUCTION Registration Form by Seller, as well as agreeing the Auction Agreement between Jumping Talent Sale B.V. and Seller.
By registering, Seller instructs YOUHORSE.AUCTION to auction a Horse and to sell it on his behalf to the highest bidder after Award by YOUHORSE.AUCTION, provided that the Horse is selected by YOUHORSE.AUCTION and admitted to the Auction.
Only horses selected by YOUHORSE.AUCTION may participate in the Auction.
YOUHORSE.AUCTION determines the criteria that horses to be selected for the Auction must meet.
YOUHORSE.AUCTION is at all times authorised to refuse a Horse without stating reasons, even if the Horse had previously already been selected for the Auction. YOUHORSE.AUCTION is never obliged, on any ground whatsoever, to reimburse costs incurred by Seller related to the Registration and/or selection.
If a registered Horse is not selected for participation in the Auction, Seller is among other things obliged to take back the Horse immediately. All costs related thereto shall be borne by Seller. Seller shall in that case remain bound by all his payment obligations towards YOUHORSE.AUCTION.
If it appears that prohibited substances have been administered to the Horse, Seller is among other things obliged to take back the Horse immediately. All costs related thereto shall be for Seller’s account. Seller shall remain obliged towards YOUHORSE.AUCTION to fulfil all payment obligations referred to in these General Terms and Conditions, insofar as these concern remuneration for the benefit of YOUHORSE.AUCTION.
Seller remains responsible for the care and supervision of the horse from the moment of Registration.
YOUHORSE.AUCTION is never obliged, on any ground whatsoever, to reimburse costs incurred by Seller related to the Registration and/or selection.
Within 7 calendar days after YOUHORSE.AUCTION has received written information from Seller concerning the date of delivery to Buyer, YOUHORSE.AUCTION shall proceed to payment to Seller of the amount owed by YOUHORSE.AUCTION to Seller, consisting of the Hammer Price minus anything Seller owes to YOUHORSE.AUCTION under these General Terms and Conditions or otherwise.
If YOUHORSE.AUCTION has received the statement referred to in 3.4.1, but Buyer and/or Seller have not yet fulfilled all (payment) obligations towards YOUHORSE.AUCTION, YOUHORSE.AUCTION shall proceed to payment of the amount owed by YOUHORSE.AUCTION to Seller no later than within 30 calendar days after the last payment obligation has been fulfilled. Seller shall not be entitled to set-off.
The Horse offered for Auction is always sold, unless no bid is made.
If no bid is made, Seller owes a fixed amount of Auction costs to YOUHORSE.AUCTION in the amount of €500.00 excluding VAT.
If Seller decides to place the final bid himself and this final bid is lower than the reserve price agreed in advance between Seller and YOUHORSE.AUCTION in the Auction Agreement, Seller shall likewise owe a fixed amount of Auction costs to YOUHORSE.AUCTION in the amount of €500.00 excluding VAT.
If Seller decides to place the final bid while the immediately preceding bid is higher than the reserve price agreed in advance by Seller and YOUHORSE.AUCTION, Seller shall owe the Buyer’s Premium over the amount of the bid immediately preceding Seller’s final bid, with a minimum of €500.00 excluding VAT.
If a registered Horse does not participate in the Auction, Seller shall immediately owe, without any notice of default being required, a penalty of 20% of the reserve amount with a minimum of €1,500.
If in the opinion of Seller a registered Horse cannot participate in the Auction for health reasons, this must be reported immediately, in writing and with as detailed a description of the condition as possible to YOUHORSE.AUCTION, after which YOUHORSE.AUCTION shall assess or have assessed the nature of the condition and determine whether or not the Horse can participate in the Auction.
If Seller gives YOUHORSE.AUCTION no or insufficient opportunity to have the Horse examined in time, or if the Horse has been approved for participation in the Auction by YOUHORSE.AUCTION or by a veterinarian approved by YOUHORSE.AUCTION and nevertheless does not participate in the Auction, Seller shall owe the aforementioned penalty of €1,500 to YOUHORSE.AUCTION. If an approved or non-approved Horse does not participate in the Auction, Seller must pay the (veterinary) costs incurred by YOUHORSE.AUCTION in that connection, with a minimum amount of €1,000 excluding any VAT due.

1.Algemeen
1.1.Definities
In deze algemene voorwaarden hebben de volgende begrippen de volgende betekenis:
Aflevercontract: het door Koper en Verkoper ingevulde en ondertekende aflevercontract waaruit blijkt dat afname van het paard door Koper heeft plaatsgevonden;
Afslagbedrag: een door de Bieder op een Veiling voor een Paard geboden bedrag;
Algemene Voorwaarden: deze algemene voorwaarden voor veilingen YOUHORSE.AUCTION, zowel de Online Veilingen alsook de Fysieke Veilingen;
Bieder: degene die zich op een door YOUHORSE.AUCTION voorgeschreven wijze registreert of heeft geregistreerd om deel te kunnen nemen aan een Online Veiling
Consument: de natuurlijke persoon die niet handelt voor doeleinden die verband houden met de uitoefening van een handels- , bedrijfs-, ambachts- of beroepsactiviteit;
Deelnemer: een deelnemer aan de Veiling, in de hoedanigheid van Bieder, Koper of Verkoper;
Gunning: de uitdrukkelijke verklaring van YOUHORSE.AUCTION (namens de Verkoper) aan de Koper dat een bod van Koper als hoogste bod is aanvaard en dat het Paard waarop door de Koper een bod is uitgebracht aan de Koper is gegund. Deze verklaring geldt als een aanvaarding namens de Verkoper in de zin van artikel 6:217 Burgerlijk Wetboek. Deze verklaring bestaat uit de Verklaring Koopovereenkomst;
Inschrijving: de inschrijving van Verkoper bij YOUHORSE.AUCTION om een Paard namens Verkoper door YOUHORSE.AUCTION ter Veiling aan te bieden;
Koopovereenkomst: de koopovereenkomst tussen Verkoper enerzijds en Koper anderzijds die tot stand komt als gevolg van de Gunning;
Koopsom: het door Koper verschuldigde bedrag voor het ter Veiling aangeboden Paard bestaande uit het Afslagbedrag plus het Opgeld, een en ander te vermeerderen met het van toepassing zijnde BTW tarief;
Koper: de Bieder aan wie Gunning heeft plaatsgevonden;
YOUHORSE.AUCTION: die de Veiling faciliteert; YOUHORSE.AUCTION is een handelsnaam van Jumping Talent sale B.V. welke eigendom is van Mario Everse h.o.d.n. Stal Everse B.V. te Waddinxveen ( NL)
Persoonsgegevens: de (persoons)gegevens die bij registratie door een Deelnemer aan YOUHORSE.AUCTION dienen te worden verstrekt om als Deelnemer te kunnen deelnemen aan een Online Veiling en die tot zijn of haar persoon herleidbaar zijn;
Online Paardveiling: de YOUHORSE.AUCTION;
Opgeld: een bedrag waarmee het Afslagbedrag wordt verhoogd en dat 10 % van het Afslagbedrag bedraagt, met een minimum van € 500,00 excl. btw;
Terugkoop: indien Koper tevens Verkoper is van het ter Veiling aangeboden Paard;
Veiling: de door YOUHORSE.AUCTION georganiseerde en faciliteerde online veiling via de Veilingwebsite (‘Online Veiling’);
Veilingdienst: het bemiddelen bij het tot stand brengen van een Koopovereenkomst door het faciliteren van een Veiling;
Veilingwebsite: de veilingwebsite waarmee YOUHORSE.AUCTION haar Veilingdienst aanbiedt;
Verklaring Koopovereenkomst: de door YOUHORSE.AUCTION (namens Verkoper) aan de Bieder/Koper toegezonden c.q. verstrekte en door Bieder/Koper in te vullen en te ondertekenen verklaring koopovereenkomst;
Verkoop: indien Koper een ander is dan Verkoper;
Verkoper: de natuurlijke persoon of rechtspersoon die aan YOUHORSE.AUCTION opdracht heeft gegeven tot het in naam van en voor rekening van Verkoper, verkopen van paarden middels een Veiling;

De eigendom van het gekochte Paard gaat (indien aan alle voorwaarden voor een rechtsgeldige overdracht is voldaan) op de Koper over op het moment van levering / afname als bedoeld in artikel 1.4 van deze Algemene Voorwaarden, maar niet eerder dan nadat de Koper de volledige koopsom en eventueel overige door Koper verschuldigde bedragen aan YOUHORSE.AUCTION, die daarbij optreedt namens de Verkoper, heeft voldaan, waaronder die betrekking hebben op de ten behoeve van de Koper verrichte of te verrichten werkzaamheden en/ of vanwege vorderingen wegens tekortschieten in de nakoming van de Koopovereenkomst.
1.6. Informatie
YOUHORSE.AUCTION stelt de (digitale) catalogus zo zorgvuldig mogelijk samen. De informatie in de (digitale) catalogus is erop gericht een indruk te geven van de kwaliteit van de (het) ter Veiling aangeboden paarden, zonder dat YOUHORSE.AUCTION hiermee volledigheid betracht en zonder dat daaraan rechten kunnen worden ontleend.
Het ter Veiling aangeboden Paard zal een veterinaire keuring ondergaan als onderdeel van de selectieprocedure voor de Veiling. De datum waarop deze keuring(en) heeft/hebben plaatsgevonden zal op verzoek kenbaar worden gemaakt, maar deze keuring(en) zal/zullen plaatsvinden binnen een aanvaardbare termijn voorafgaand aan de datum van de online veiling. Deze veterinaire rapporten zijn op te vragen bij YOUHORSE.AUCTION. De inhoud van deze veterinaire rapporten is bindend voor YOUHORSE.AUCTION en voor de Deelnemer.

1.9. Privacy Verklaring
YOUHORSE.AUCTION zal de Persoonsgegevens gebruiken overeenkomstig het bepaalde in de Privacy Verklaring op haar Veilingwebsite. Deelnemer dient steeds bij een bezoek aan de Veilingwebsite de laatste wijzigingen van de Privacy Verklaring te raadplegen. Deelnemer stemt ermee in dat zijn Persoonsgegevens bij registratie c.q. aanmelding worden gebruikt voor opname in het prospectus. Deelnemer verstrekt YOUHORSE.AUCTION een onvoorwaardelijke toestemming om deze Persoonsgegevens onder meer te gebruiken ten behoeve van het prospectus.

2. De Consument-Koper kan — in geval van een verkoop tussen niet-Consument Verkoper en een Consument Koper — een Koopovereenkomst met betrekking tot de aankoop van een Paard via een Online Veiling gedurende een bedenktijd van maximaal 14 kalenderdagen zonder opgave van redenen op basis van het wettelijk herroepingsrecht van artikel 6:230o e.v. Burgerlijk Wetboek ontbinden. De Verkoper mag de Koper vragen naar de reden van herroeping, maar kan deze niet tot opgave van zijn reden(en) verplichten. De in dit artikel genoemde bedenktijd gaat in op de dag nadat de Koper, of een vooraf door de Koper aangewezen derde, die niet de vervoerder is, het gekochte Paard heeft ontvangen.
3. Als de Koper gebruik maakt van het wettelijke herroepingsrecht, meldt de Koper dit binnen de bedenktermijn op ondubbelzinnige schriftelijke wijze aan de Verkoper en YOUHORSE.AUCTION. Deze kennisgeving dient zo snel mogelijk te geschieden, maar binnen 14 kalenderdagen vanaf de dag volgend op de in dit artikel bedoelde melding, stelt de Koper het Paard weer ter beschikking c.q. of overhandigt de Koper het Paard aan Verkoper. Dit hoeft niet als de Verkoper heeft aangeboden het Paard zelf af te halen. De Koper heeft de termijn van 14 dagen in elk geval in acht genomen als hij het Paard terug transporteert voordat de bedenktijd is verstreken.
4. De Koper levert het Paard terug aan Verkoper met — voor zover van toepassing alle geleverde toebehoren, en conform de door de Verkoper verstrekte redelijke en duidelijke instructies.
5. Het risico en de bewijslast voor de juiste en tijdige uitoefening van het herroepingsrecht ligt bij de Koper.
6. De kosten verband houdende met de terug levering van het Paard, waaronder het transport, zijn voor rekening van Koper.
7. Koper zal tijdens de bedenktijd en terugzending zorgvuldig omgaan met het Paard en, indien verstrekt, volgens instructie van Verkoper.
8. Als de Koper gebruik maakt van het wettelijke herroepingsrecht, worden alle aanvullende overeenkomsten van rechtswege ontbonden. Verkoper blijft in geval van herroeping het opgeld aan YOUHORSE.AUCTION verschuldigd.
9. Verkoper betaalt de Koopsom (inclusief de eventuele door de verkoper bij de koper in rekening gebrachte kosten voor transport van het Paard voor aflevering bij Koper) binnen 14 kalenderdagen volgend op de dag waarop de Koper de herroeping meldt op voorwaarde dat de Verkoper het paard binnen deze 14 kalenderdagen heeft ontvangen. Tenzij de Verkoper aanbiedt het Paard zelf af te halen, mag de Verkoper dus wachten met terugbetalen tot hij het Paard heeft ontvangen, ook als daarmee de in dit artikel genoemde termijn van 14 dagen wordt overschreden.
10. Verkoper gebruikt voor terugbetaling hetzelfde betaalmiddel dat de Koper heeft gebruikt, tenzij de Koper instemt met een andere methode. De terugbetaling is kosteloos voor de Koper.
11. Als de Koper heeft gekozen voor een duurdere methode van transport van het Paard, hoeft de Verkoper de bijkomende kosten voor de duurdere methode niet terug te betalen.
12. Koper is aansprakelijk jegens Verkoper voor eventuele waardevermindering van het Paard ontstaan in de periode tussen (af)levering aan Verkoper en terug levering aan Koper.
13. Indien Koper gebruik maakt van het herroepingsrecht als bedoeld in artikel 2.3 lid 2 dan is de koper onverminderd zijn rechten en verplichtingen die daaruit voortvloeien jegens de Verkoper, te allen tijde annuleringskosten verschuldigd aan YOUHORSE.AUCTION. Deze annuleringskosten bedragen 10% van het Afslagbedrag, met een minimum van € 1.500,00 excl. BTW.
